We do not hold any personal data. Instead, personal data is stored on a remote secure server and used and is the full responsibility of Hosting Ireland Limited who host the website. By visiting our website you are accepting the terms of this privacy Policy. As part of the operations of our website we will retain both your personal on non-personal billing address and shipping address and product selection. Credit card information is not collected by us is passed to your payments service provider.

Non –personal information – We gather statistical and other analytical information collected on an aggregate basis of all visitors to our website. This Non-Personal Data comprises information that cannot be used to identify or contact you, such as demographic information regarding, for example, user IP addresses where they have been clipped, browser types and other anonymous statistical data involving the use of our website.

PRICE OF GOODS
The price listed on the Website for products will be as stipulated at the time when you place your order on the website. We are entitled to make adjustments to the price to take account of any increase in our supplier’s prices, or the imposition of any new taxes or duties, or if due to an error or omission the price for the products on the Website is wrong.
DELIVERY
We will endeavour to deliver the products to you within the lead-time shown for each product at the time of purchase (Nationwide Delivery 3 – 5 working days), within the island of Ireland, where this is practical. However, products are subject to availability and delays may sometimes occur that are outside of our control. Any dates specified for delivery are therefore approximate only. If delivery is delayed for more than 21 days, you have the right to contact us and refuse to accept the products. In these circumstances, we will refund any money paid by you for those products and any delivery monies you have been charged. However, we will not be responsible for any other losses, costs, damages or charges that you may suffer if we delay in supplying or do not supply those products. At the time of delivery, you will be required to validly sign-off on the delivery of the products, after which time the products become your sole responsibility.
CLAIMS
You have a statutory right to a 14 day cooling-off period when purchasing online. You have a right to cancel the contract within 14 calendar days without giving any reason and without penalty, except the cost of returning the goods. If a product is defective in any way, please return it with a covering letter and we will either deliver a new one to you or refund you the cost of the product.
SPECIFICATIONS
All descriptive matter, drawings, pictures, colours, specifications and advertising on the website are for the sole purpose of giving an approximate description of the products.
DISCLAIMER OF WARRANTIES
The information contained in the website is for information purposes only and, although we have made every effort to ensure the correctness of the information contained herein, the information available through the website is provided “as is” and “as available” and without warranties or conditions of any kind either express or implied. We do not warrant or represent that the use or the results of the use of the materials available through the Website or from third parties will be correct, accurate timely, reliable or otherwise. We accept no liability in relation to any of the above other than as may be provided for under your statutory rights.
LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, under no circumstances, including, but not limited to, negligence, shall we be liable to you for any direct, indirect, incidental, special or consequential damages that result from the use of or the inability to use the Website, any changes to the Website, any material or data sent or received or not sent or received or for any of the above-mentioned damages that result from the use or inability to use the Products. In no circumstances shall our liability and that of our suppliers to you and/or any third parties for any of the above exceed €200.

You acknowledge that content, including but not limited to text, software, music, sound, photographs, video, graphics or other material contained in either sponsor advertisements or email-distributed, commercially produced information presented to you on the Website by us, or our advertisers or other content providers, is protected by copyrights, trademarks, service marks, patents or other proprietary rights and laws.
CONTRACT
No contract will subsist between you and Boss Garden & Farm Machinery for a sale to you of any product or service unless and until Boss Garden & Farm Machinery accepts your order by e-mail confirming that it has dispatched your order. That acceptance will be deemed complete and will be deemed for all purposes to have been effectively communicated to you at the time Boss Garden & Farm Machinery sends the e-mail to you (whether or not you receive that e-mail).
We reserve the right to change the terms of use or policies regarding the use of the website (including, in particular, those relating to price or availability) at any time and to notify you by posting an updated version of the terms of use on the Website.
GENERAL
We shall not be liable for any failure to perform any of our obligations under these terms and conditions which is caused by circumstances beyond our reasonable control including, but not limited to any force majeure incident. Our failure to exercise or enforce any right or provision of the terms of use shall not constitute a waiver of such right or provision unless acknowledged and agreed to by us in writing. The section titles in the terms of use are solely used for the convenience of the parties and have no legal or contractual significance.
LAWS
The terms of use shall be governed by and construed fully in accordance with the laws of Ireland. You and we agree to submit to the exclusive jurisdiction of the courts located in Ireland. If any provision(s) of the terms of use is held by a court of competent jurisdiction to be contrary to law, then such provision(s) shall be construed, as nearly as possible, to reflect the intentions of the parties with the other provisions remaining in full force and effect.
TERMINATION
We may terminate the Website with or without cause at any time and effective immediately. In addition, we, in our sole discretion, may terminate your Account for violation of the letter or spirit of these terms and conditions.

Returns, Cancellation and Faulty Goods Policies
RETURN – Non Faulty Goods / Product Not Wanted
When you make an online purchase you have a statutory right to return goods (other than perishable or made to order/customised goods) up to 14 days after receiving your order. If you wish to return your order you must contact Boss Garden & Farm Machinery in writing or email info@bossgfm.ie with the order reference number. The goods must be in an ‘as new’ condition and returned in the original, undamaged packaging, along with any accessories and free gifts received with it. The product must NOT have been used. The order will be exchanged or refunded upon receipt of the goods and the goods being returned to store. Return of goods is at customers own risk & expense – if the item is returned damaged/unsellable then a full refund cannot be guaranteed. No refund will be issued if you still have the goods in your possession or they are traveling through courier networks.
Please note: the original delivery fee will not be refunded for change of mind orders. This does not affect your rights.
RETURN: Faulty / Damaged Product
We take every care to try to ensure that your purchase arrives at your door in perfect condition. However on rare occasions a product may get damaged in transit.
If you do receive a transit damaged product then you need to contact us straight away (within 24 hours) by e-mail at info@bossgfm.ie or by phone at 0873923984 or 0830268361. We will arrange a collection (free of charge) and issue either a refund or a replacement product. Please ensure that you do not use the product.
RETURN: Product Appears To Be Faulty
If you believe that your product may be faulty then please:
- Check all connections to ensure that they are securely in place
- Ensure that you have read the trouble shooting section of the manual as it may be a common fault that can be easily resolved
If you cannot resolve the problem then you can either bring the product to our store along with your receipt or e-mail us at info@bossgfm.ie and we will advise on how to proceed.
REFUND POLICY
You have TWO options on how you can receive a refund from Boss Garden & Farm Machinery:
1. Email us firstly at info@bossgfm.ie, quoting your order number and then send the product back to our store. Once the product arrives back to our store, we will then give you a full refund for the cost of the product plus the delivery charge paid if it is a faulty/ damaged product. (The delivery charge will not be refunded for ‘Non Faulty Goods / Product Not Wanted)
2. You can return the product to our store. You will be required to produce the receipt and also the card that you paid with, so that we can refund it.
Note: Refunds will take 5-7 working days to be credited to your card.
CANCELLATION
We can change or cancel an order up until it is dispatched from us. Contact us IMMEDIATELY by e-mail at info@bossgfm.ie or by phone at 0873923984 or 0830268361. Once the order has been dispatched you must follow our returns policy above.
